prison.

• Court granted petition for review, and remanded to the BIA with
instructions to reconsider whether a violation of
Cal. Penal Code § 459 was a crime of moral turpitude under the
categorical and modified categorical approaches established in
Taylor and for further proceedings consistent with the court's
determination that the stop-time rule of 8 U.S.C.S. § 1229b(d)(1)(B) did not apply retroactively to
petitioner.
• As a result of this win, Ninth Circuit reversed the judgment against
Petitioner and granted writ of habeas corpus leading to release of
Appellant from incarceration.
